General Terms and Conditions of Daimler Buses GmbH for Access to Service Information and Other Technical Information for Buses of the Mercedes-Benz and SETRA Brands via the OMNIplus BusDoc After-Sales Online Platform.
The following general terms and conditions apply to access to service information and other technical information via OMNIplus BusDoc of Daimler Buses GmbH.

A. General regulations
I. Scope of application
1. The following general terms and conditions apply to paid access via the aftersales online platform OMNIplus BusDoc of Daimler Buses GmbH, Fasanenweg 10, 70771 Leinfelden-Echterdingen, Germany, (“Daimler Buses”) to service information and other technical information for Mercedes-Benz and Setra buses.
2. Insofar as the OMNIplus BusDoc Terms of Use ("Terms of Use") contain a deviating provision, this shall take precedence over the General Terms and Conditions.
3. Other general terms and conditions of the customer shall not apply even if Daimler Buses has not expressly objected to them. This non-acceptance applies even if the customer refers to their own general terms and conditions or terms and conditions of purchase in their order confirmation.
II. Contract conclusion and ordering process
1. The customer's order represents an offer to Daimler Buses to conclude a contract. The customer is bound to the order for a maximum of two weeks.
2. In the first step, the customer registers for BusDoc at omniplus.com. In the registration overview, they can view the details of the registration.
3. The customer orders the desired technical information within BusDoc. Before completing the ordering process by clicking on the “Order for a fee” button, the customer can check all the details again and correct them if necessary. The terms and conditions of sale are displayed before the ordering process is completed.
4. A contract is only concluded when Daimler Buses activates the customer’s access to the technical information. The Customer receives a notification from Daimler Buses upon successful activation. Daimler Buses shall inform the Customer in writing without delay if the order is not accepted.
III. Prices
1. Prices are generally final prices net plus statutory VAT, insofar as the amounts are subject to VAT.
2. The fee is charged by Daimler Buses at the end of each calendar year.
3. However, all price information on the Internet pages, catalogues, brochures and in the order confirmation of Daimler Buses is subject to possible typographical, printing or arithmetic errors and is not binding.
4. An annual service fee of €150 is charged for the activation of the BusDoc service. The service fee is not due at the end of the calendar year, provided that the user has configured the desired functional scopes independently via the self-service area in BusDoc or the available overall package has been ordered. After selecting the desired scopes, the service fee is omitted and only the booked services are charged. If the user does not select individual functional scopes or book the entire package in the second year after activation, the customer’s access will be deleted. You can re-register at any time.
B. Special provisions
The following regulations apply to all orders placed by the customer for the fee-based access and use of the technical information.
I. Provision of technical information, term
During the term of the Agreement, the Customer is entitled to access the technical information and use it. The technical information is provided by Daimler Buses. The Customer’s use of the technical information is subject to the Terms of Use for OMNIplus DusDoc (hereinafter collectively referred to as the “Terms of Use”).
II. Payment
1 . The usage access fee payable by the user is composed as follows:
a. continuous annual licence, it applies for the current calendar year and - in the event of an unterminated contractual relationship - is due again on 1 January of each new calendar year.
b. limited annual, monthly, daily, hourly licence, it applies for the booked term and must be paid in advance.
The amount of the specific fee to be paid depends on the scope of access authorization selected by the user and the current prices.
2. The prices stated on the order are net prices excluding VAT. The applicable statutory value added tax must be paid with the access authorization fees.
3. The usage access fees for the continuous annual licence specified under II. 1. a. shall be charged by Daimler Buses at the end of each calendar year.
III. Early termination
1. If the customer terminates access according to 8.3 of the Terms of Use, the Customer shall not be entitled to a (proportional) refund of the agreed fee for access.
2. Should Daimler Buses (a) deactivate access to the technical information in accordance with 4.3 of the Terms of Use or (b) terminate access to the technical information in accordance with 8.2 of the Terms of Use for good cause, the Customer shall not be entitled to a (pro rata) refund of the fee paid by the Customer for accessing the relevant technical information.
IV. Complaints handling
1. The Customer may contact the department named under C.I. with any questions or complaints regarding access to technical information.
2. If Daimler Buses does not provide the technical information in accordance with the Terms of Use, the fee paid by the Customer for the relevant Services will be refunded pro rata for the relevant period. Other legal claims of the Customer remain unaffected.
note: As described in the Terms of Use (here in particular in 4.6), restrictions, inaccuracies, impairments and disruptions may occur when accessing the technical information. In addition, the technical information - as described in the agreement concluded between the Customer and Daimler Buses - may change (in particular under 4.4 of the Terms of Use).
3. The description of the technical information in the Terms of Use does not give rise to a guarantee or a procurement risk independent of fault.
4. This section IV. does not apply to claims for damages. These are subject to Section V. Liability.
V. Liability
1. If Daimler Buses is liable under applicable law for damage caused by slight negligence, Daimler Buses’ liability shall be limited as follows: Liability exists only in the event of a breach of material inherent obligations arising from the use of the technical information, such as those which the Terms of Use are intended to impose on Daimler Buses according to their content and purpose or whose fulfilment is essential for the proper performance of the contractual relationship and on whose compliance the Customer regularly relies and may rely. This liability is limited to typical damage foreseeable at the time the Terms of Use take effect.
If the Customer is a business person acting in the course of his commercial or self-employed professional activity when concluding the Terms of Use, the same shall apply to damage caused by gross negligence, but not in the event of gross negligence caused by legal representatives or officers of Daimler Buses.
2. Regardless of any fault on the part of Daimler Buses, any liability of Daimler Buses arising from the assumption of a warranty or a procurement risk and in accordance with the German Product Liability Act (ProdHaftG) or other applicable product liability laws shall remain unaffected.
3. The personal liability of the legal representatives, vicarious agents and employees of Daimler Buses for damage caused by them through slight negligence is excluded. The limitation of liability regulated in this respect for Daimler Buses shall apply mutatis mutandis to damage caused by them, with the exception of legal representatives and senior managers, through gross negligence.
4. The limitations of liability in this section do not apply in the event of injury to life, limb or health.

II. Place of performance, place of jurisdiction and applicable law
1. The place of performance and exclusive place of jurisdiction for all present and future claims arising from or in connection with this contractual relationship is Stuttgart, if the Customer does not have a place of jurisdiction in one of the Target Countries, moves its registered office to a country outside the Target Countries after conclusion of the Terms of Use, or its registered office is not known at the time the action is brought.
2. Daimler Buses is always entitled to sue the Customer at its general place of jurisdiction. In all other respects, the place of performance and place of jurisdiction for all claims between Daimler Buses and the Customer shall be the Customer’s permanent place of business. If the Customer is a consumer, the Customer’s right to bring legal action against Daimler Buses at the registered office of Daimler Buses remains unaffected.
3. The present relationship between the Customer and Daimler Buses is governed by the law of the Federal Republic of Germany.
4. The United Nations Convention of 11 April 1980 on Contracts for the International Sale of Goods shall not apply.
